These Terms of Service ("Terms") govern your use of all websites operated by Mowser, including mowser.com.au, shop.mowser.com.au, blog.mowser.com.au, and any associated subdomains, and any products, services, courses, or content provided by Mowser.

By accessing any Mowser website, subscribing to our newsletter, or purchasing any of our products or services, you agree to these Terms. If you do not agree, please do not use our websites or services.

Mowser is operated by Matthew Will, based in Launceston, Tasmania, Australia.

Eligibility

You must be at least 18 years of age to purchase products or services from Mowser. By making a purchase, you confirm that you are 18 or older.

You may subscribe to our free newsletter and access free content regardless of age, but minors should have parental permission.

Our services

Mowser provides:

• A weekly hiking newsletter delivered by email.
• Free hiking education content via YouTube, blog posts, and downloadable resources.
• Paid digital products including ebooks, courses, and trip planning services.
• Paid physical products including coffee, books, and merchandise.
• The Multi-Day Readiness Quiz and other free interactive tools.

We may modify, add, or remove products and services at any time.

Newsletter and email

When you subscribe to our newsletter, you agree to receive regular email communications from us. These may include educational content, product announcements, special offers, and other information related to hiking and outdoor activities.

You can unsubscribe at any time using the link at the bottom of any newsletter email.

We will never sell, rent, or share your email address with third parties for marketing purposes.

Free content and resources

Free content provided through our websites, YouTube channel, newsletter, and downloadable resources is for your personal, non-commercial use. You may not republish, redistribute, or sell our free content without our written permission.

You may share links to our content on social media and refer friends to our newsletter and resources.

Paid products and services

When you purchase a product or service, the purchase is governed by these Terms together with our Refund Policy and any product-specific terms communicated at the time of purchase.

Digital products (such as the Pathfinder ebook) are delivered by email after purchase. Once delivered, digital products are generally non-refundable except where required by Australian Consumer Law (see our Refund Policy).

Physical products (such as Mowser Trail Blend coffee, books, and merchandise) are dispatched from Launceston, Tasmania within 2 business days of order. See our Shipping Policy for delivery details.

Online courses (such as the Multi-Day Hiking Blueprint) are hosted on third-party platforms (currently Systeme.io). When you purchase a course, you receive lifetime access to the course content for as long as the course remains active. We may update or modify course content at our discretion.

Trip Plan Review and similar consulting services are provided personally by Matthew Will. Delivery times and scope are communicated at the time of purchase.

All prices are listed in Australian Dollars (AUD) and include GST where applicable.

Intellectual property

All content on our websites, in our newsletter, in our courses, in our products, and on our YouTube channel is the property of Mowser (Matthew Will) and is protected by Australian and international copyright law.

You may:

• Read, watch, and use our content for personal hiking education.
• Quote short passages with attribution and a link back to the source.
• Share links to our content on social media.

You may not:

• Copy, reproduce, or republish our content in whole or in substantial part without written permission.
• Use our content to train artificial intelligence models or machine learning systems.
• Use our brand name, logo, or trademarks without written permission.
• Sell or redistribute our paid products in any form.
• Use our content in any way that misrepresents your relationship with Mowser.

The Mowser name, logo, and brand assets are trademarks of Matthew Will.

Important disclaimer about hiking and outdoor activities

Multi-day hiking and outdoor activities involve inherent risks, including but not limited to risk of injury, illness, exposure, getting lost, and in some cases death.

Our content, courses, and products are provided for general educational purposes only. They are not a substitute for:

• Professional guiding services.
• Wilderness first aid training.
• Personal judgement about your own fitness, experience, and risk tolerance.
• Local knowledge of specific tracks, weather conditions, and hazards.
• Official safety information from park authorities and emergency services.

You are solely responsible for:

• Your own safety and the safety of those in your party.
• Assessing your fitness, skills, and experience for any hike you undertake.
• Carrying appropriate gear, food, water, and safety equipment.
• Checking weather forecasts and current track conditions.
• Logging your trip with appropriate authorities (such as the Tasmanian Parks and Wildlife Service).
• Carrying and knowing how to use a personal locator beacon (PLB) on remote hikes.
• Making your own decisions in the field, including the decision to turn back.

Matthew Will holds qualifications including Certificate III in Tourism Guiding and has extensive personal hiking experience. However, our content does not constitute personal professional advice for your specific circumstances. If you are uncertain about your readiness for a hike, consult a qualified guide, complete a wilderness first aid course, and seek advice from local hiking authorities.

Matthew Will is also a qualified pharmacist. However, no content provided by Mowser constitutes medical advice. Always consult a qualified medical practitioner for medical questions, including questions about medications, first aid, and personal health considerations for hiking.

By using our content and products, you acknowledge these risks and agree to take full responsibility for your own decisions and actions in the outdoors.

Limitation of liability

To the maximum extent permitted by law, Mowser, Matthew Will, and any associated parties are not liable for any direct, indirect, incidental, consequential, or special damages arising from your use of our websites, content, products, or services. This includes but is not limited to damages arising from injury, loss of property, or any other harm sustained while undertaking outdoor activities.

This limitation does not exclude or limit any rights you have under Australian Consumer Law that cannot be excluded or limited.

In any case, our total liability for any claim arising from your use of our products or services is limited to the amount you paid for that product or service.

Indemnification

You agree to indemnify and hold harmless Mowser and Matthew Will from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our websites, products, or services, your violation of these Terms, or your violation of any rights of another party.

User conduct

When using our websites or interacting with our community (including comments on our YouTube channel, replies to our newsletter, and any other communications), you agree to:

• Communicate respectfully with us and other community members.
• Not use our services for any unlawful purpose.
• Not attempt to gain unauthorised access to our systems, accounts, or content.
• Not impersonate any other person.
• Not transmit viruses, spam, or other harmful content.

We reserve the right to remove or block any user who violates these standards.

If you create an account on any of our platforms (course platform, shop), you are responsible for:

• Providing accurate and current account information.
• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorised use of your account.

Termination

We may suspend or terminate your access to our services at any time, with or without notice, for any violation of these Terms or for any other reason at our discretion.

You may stop using our services at any time. You can unsubscribe from the newsletter, request deletion of your account, and request deletion of your personal data per our Privacy Policy.

Our content may contain links to third-party websites and services. We are not responsible for the content, accuracy, or practices of any third-party websites. Following these links is at your own risk.

These Terms are governed by the laws of Tasmania, Australia. Any disputes arising from these Terms or your use of our services will be resolved in the courts of Tasmania.

Severability
